Chapter 3 then considers the Rent Act (RA) 1977 and the security and rent control provisions that apply to regulated tenancies. In Chapter 6, the security given to public sector tenants is discussed at length. The chapter starts by looking at the allocations criteria that local housing authorities (LHAs) have to apply in selecting their tenants. All these provisions are within the Housing Act (HA) 1985 as amended. On a less detailed basis, the statutory security offered to long leaseholders is also considered in Chapter 8.
They also noted (at p 88) that a positive impact of mandatory licensing has been improvement in the fire safety provisions in many HMOs. 3 Selective licensing of houses Part 3 of the HA 2004 contains licensing provisions similar to those in Pt 2. The houses will be those that are occupied under a single tenancy, or under multiple tenancies in respect of different dwellings (HA 2004, s 79).

A term will be regarded as unfair if, contrary to the requirements of good faith, it causes a significant imbalance in the parties’ rights and obligations under the contract to the detriment of the consumer (see UTCCR 1999, regs 3–5). The assessment of fairness of a term will not relate to the premises demised or the rent payable, although there is a general requirement, which applies to these key terms too, that terms be written in plain, intelligible language (UTCCR, 1999, regs 6(2), 7).
